ACCEPTANCE OF TERMS

www.soulfulvessel.com AND www.andreanicholas.simplero.com (THE “SITE”),
OR BY PURCHASING ANY PRODUCT OR SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS AND OUR PRIVACY POLICY.
If you do not agree, do not use the Site or Services.

ACCOUNT CREATION
If you create an account, you agree to provide accurate, current, and complete information and to maintain the security of your login credentials.
You are responsible for all activity under your account.
REFUSAL OF SERVICE
We reserve the right to refuse or discontinue service to any individual or entity at any time, for any reason, without obligation to provide an explanation, provided that prior paid obligations are honored.
ORDERS AND CONFIRMATION
Order confirmations are sent via email. If you believe there is an error, you must notify us promptly at hello@soulfulvessel.com.
CANCELLATIONS, REFUNDS, AND RETURNS
All sales are final and non-refundable unless otherwise expressly stated in writing prior to purchase.
No refunds are provided for:
One-on-one mentorship
Group mentorship
Consulting
Speaking engagements
Media appearances
Contracts for one-on-one services cannot be canceled once purchased.
PRODUCT AND SERVICE DESCRIPTIONS
We strive for accuracy but do not guarantee that descriptions, pricing, or availability are error-free.
We reserve the right to correct errors and to refuse or cancel orders placed with incorrect pricing.
USER-SUBMITTED MATERIALS
You represent that any materials you submit are owned by you or that you have permission to use them.
You are solely responsible for any infringement or harm arising from your submissions.
INTELLECTUAL PROPERTY – USER CONTENT
You retain ownership of content you submit.
By submitting content, you grant Andrea Nicholas and Whole World International a worldwide, non-exclusive, royalty-free license to use such content for promotional, marketing, and business purposes.
You agree to indemnify and hold us harmless from any claims related to your content.
INTELLECTUAL PROPERTY – OUR CONTENT
All Site content, including text, graphics, recordings, programs, and materials, is owned by Andrea Nicholas and is protected by intellectual property laws.
You may not reproduce, distribute, or exploit any content without prior written consent.
Violation may result in immediate removal from services without refund.
LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANDREA NICHOLAS AND WHOLE WORLD INTERNATIONAL SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR SERVICES.
If liability is found, total liability shall not exceed:
The amount paid for the Service, or
$100 USD, if no purchase has been made.
AFFILIATE DISCLOSURE
Some links may be affiliate links. Andrea Nicholas may receive compensation for purchases made through those links. All recommendations are based on personal experience or professional judgment.
GOVERNING LAW; VENUE; DISPUTE RESOLUTION
This Agreement shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict-of-law principles.
Venue for any legal action, suit, or proceeding arising out of or relating to this Agreement shall be Franklin County, Ohio, or, at the election of Andrea Nicholas and Whole World International, Travis County, Texas.
Prior to initiating any legal action, the parties agree to attempt in good faith to resolve any dispute, claim, or controversy arising out of or relating to this Agreement through mediation. Good faith participation in mediation shall be a condition precedent to pursuing litigation or any other legal or equitable remedy, except where prohibited by law.
ENTIRE AGREEMENT
These Terms constitute the entire agreement between you and Andrea Nicholas and supersede all prior agreements.
No waiver shall be valid unless in writing and signed by Andrea Nicholas.
PRIVACY POLICY
INFORMATION WE COLLECT
We collect personal information you voluntarily provide, including:

Billing information
We use this information to process transactions, communicate with you, and improve services.
THIRD-PARTY SERVICES

MENTORSHIP DISCLAIMERS AND AGREEMENTS
NATURE OF SERVICES
Mentorship services are educational and experiential in nature and do not constitute therapy, counseling, medical care, or psychological treatment.
Andrea Nicholas is not a licensed psychologist, psychiatrist, or medical provider.
Mentorship does not diagnose, treat, cure, or prevent any mental or physical condition.
CLIENT RESPONSIBILITY
The mentor facilitates insight and reflection; the client is solely responsible for implementing change and for all decisions and outcomes.
MENTAL HEALTH DISCLOSURE
If mental health challenges arise, the client agrees to notify Andrea Nicholas so appropriate referrals can be discussed.
Mentorship does not provide crisis support.
CONFIDENTIALITY
Information shared within mentorship containers is confidential except as required by law.
Absolute confidentiality cannot be guaranteed in group settings, and participants agree to respect the privacy of others.
INTELLECTUAL PROPERTY
Clients may not reproduce, distribute, or resell mentorship materials.
RELEASE OF LIABILITY
Participation is voluntary and undertaken at the client’s own risk.
Andrea Nicholas and Whole World International are not liable for actions taken by the client as a result of mentorship.
Services are provided “as is,” without warranties of any kind.
